Nelson Thammy Kubheka, the former Municipal Manager of Dr JS Moroka Municipality, has been sentenced by the Mpumalanga Specialised Commercial Crimes Court for violating the Municipal Finance Management Act (MFMA).
Kubheka received a R50,000 fine or a two-year prison term, along with a two-year suspended sentence, provided he does not commit similar offenses within five years.
Initially facing 36 charges, including fraud and theft, Kubheka was convicted on only one count of MFMA contravention related to R1.8 million of a R4.8 million overspend in 2019. The court found that proper procurement procedures were not followed but acquitted him of the other charges.
